Does DFCS agency share liability for placing a child in a day care center caring for less than three children? The owner (or employees) is not required to have a criminal record check or finger print check in this situation.
The fact that there is no criminal records check required is not relevant. DFCS maintains responsibility. Any potential lawsuit filed would simply state that DFCS chose the particular vendor negligently.
Should the local DFCS agency require finger printing and criminal records checks on school bus drivers when contracting with a local school system?
Yes. In this case the local school system is not acting in its official role as a school system and, consequently, its regular insurance would not apply. The school system is acting as a vendor in this case and all requirements on vendors would apply including, finger printing and criminal records checks.
How often should criminal record checks and finger print check be repeated?
They are only good as the day they are checked by GCIC! They should be renewed at least every five years.
