- Does DFCS agency share liability for placing a child in a day care center caring for less than three children? The owner (or employees) is not required to have a criminal record check or finger print check in this situation.
- The fact that there is no criminal records check required is not relevant. DFCS maintains responsibility. Any potential lawsuit filed would simply state that DFCS chose the particular vendor negligently.
- Should the local DFCS agency require finger printing and criminal records checks on school bus drivers when contracting with a local school system?
- Yes. In this case the local school system is not acting in its official role as a school system and, consequently, its regular insurance would not apply. The school system is acting as a vendor in this case and all requirements on vendors would apply including, finger printing and criminal records checks.
- How often should criminal record checks and finger print check be repeated?
- They are only good as the day they are checked by GCIC! They should be renewed at least every five years.
